Terms of Service

These Terms govern your use of Factory.ai, an adults-only fictional AI companion service operated by Himalaya Trading Company.

1. Adults only

You must be at least 18 years old and legally capable of entering into a contract. By creating an account or using the service, you confirm that you are 18 or older. We may suspend access where age eligibility is doubtful.

2. AI disclosure

Every companion is fictional and AI-generated. It is not a real person, partner, therapist, doctor, lawyer or financial adviser. Replies and images may be inaccurate, repetitive or unexpected. Do not rely on the service for emergencies or professional decisions.

3. Account responsibility

You are responsible for your login credentials and all activity through your account. Provide accurate information, keep your password private and notify us if you suspect unauthorized access.

4. Permitted use

The service is for lawful, private entertainment by adults. You must not request or upload content involving minors, sexual exploitation, non-consensual intimate material, real-person impersonation, violence, threats, fraud, illegal activity, infringement of third-party rights, malware or attempts to bypass security and billing controls.

5. Chats and images

AI responses are generated automatically. Free gallery photos may be reused from our database. Custom images may consume paid credits and may be stored in your account so they can be accessed again. Availability and output quality are not guaranteed.

6. Plans, credits and pricing

Prices, validity, included chats and credits are displayed before purchase. A purchase is completed only after explicit confirmation. Credits and character unlocks have no cash value, cannot be transferred and may be subject to reasonable anti-fraud limits. Current soft-launch payments may be manually verified before access is activated.

7. Suspension and termination

We may restrict or terminate access for violations, fraud, abuse, security risk, legal requirements or material harm to the service or others. You may stop using the service and request account deletion through the Contact page.

8. Service availability

We may update, pause or discontinue features. Internet, hosting, database and third-party AI outages can affect availability. We will use reasonable care but do not promise uninterrupted or error-free operation.

9. Intellectual property

The application, branding, software and supplied assets remain owned by their respective rights holders. You retain rights in content you lawfully provide and give us a limited permission to process it only to operate, secure and improve the service.

10. Liability

To the extent permitted by applicable law, the service is provided on an “as available” basis. We are not responsible for indirect or consequential loss. Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

11. Governing law and changes

These Terms are governed by the laws of India, subject to mandatory consumer protections. Material changes will be shown in the app and may require renewed acceptance.
