Terms of Service

These Terms govern your use of Noni, an adults-only fictional AI companion service operated by Himalaya Trading Company.

1. Adults only

You must be at least 18 years old and legally capable of entering into a contract. By creating an account or using the service, you confirm that you are 18 or older. We may suspend access where age eligibility is doubtful.

2. AI disclosure

Every companion is fictional and AI-generated. It is not a real person, partner, therapist, doctor, lawyer or financial adviser. Replies and images may be inaccurate, repetitive or unexpected. Do not rely on the service for emergencies or professional decisions.

3. Account responsibility

You are responsible for your login credentials and all activity through your account. Provide accurate information, keep your password private and notify us if you suspect unauthorized access.

4. Permitted use

The service is for lawful, private entertainment by adults. You must not request or upload content involving minors, sexual exploitation, non-consensual intimate material, real-person impersonation, violence, threats, fraud, illegal activity, infringement of third-party rights, malware or attempts to bypass security and billing controls.

5. Chats, images and profile photos

AI responses are generated automatically. Companion and custom images are fictional synthetic content and are displayed with an “AI-generated · Fictional” notice. Generated files may also contain a persistent provenance identifier. Free gallery photos may be reused from our database. Custom images may consume paid credits and may be stored in your account so they can be accessed again. If you upload a profile photo, you confirm that you own it or have permission from every identifiable person shown. You must not use another person's photo without permission, impersonate a real person, or violate privacy, publicity or intellectual-property rights. We may remove a reported photo or restrict an account where reasonably necessary. Availability and output quality are not guaranteed.

6. Noni Credits, monthly validity, Gift NC and pricing

Recharge price, NC quantity, validity and feature costs are displayed before purchase or use. Each verified ₹500 validity recharge adds 2,500 NC to the user's existing NC balance and activates or extends paid access for 30 days. Unused NC rolls over and does not expire merely because monthly validity ends; however, active paid validity is required to spend NC on chat or photo features and to gift NC to a friend. A new ₹500 validity recharge is required after expiry even when unused NC remains. Noni Credits are non-cash digital service units and cannot be converted into cash, withdrawn to a bank account or UPI, sold, or exchanged for money. NC cannot themselves be used to purchase or renew validity; validity is purchased separately only through the displayed rupee payment checkout. NC can be used only for Noni's own in-app chat and photo features and cannot be used with any third-party merchant, product or service. Eligible paid members may use “Gift NC to a Friend” only to gift limited NC to another registered active paid member for these same Noni features. A gift is final except for a verified technical error, fraud, chargeback or a remedy required by law. Users must not sell, broker or exchange gifted NC for money or anything of monetary value. Referral NC is credited only after the referred user's qualifying payment is verified and may be withheld or reversed for self-referral, duplicate accounts, chargebacks, fraud, abuse or other invalid activity.

7. Payments and billing

Payments may be processed by an authorised third-party payment provider. We do not ask you to share card PINs, CVV, UPI PINs, OTPs or banking passwords with Noni support. Payment success shown by a client screen alone does not create entitlement; access is provisioned after server-side verification. Unless a checkout expressly states that a product renews automatically, purchases are one-time and do not auto-renew.

8. Suspension and termination

We may restrict or terminate access for violations, fraud, abuse, security risk, legal requirements or material harm to the service or others. You may stop using the service and request account deletion through the Contact page.

9. Service availability

We may update, pause or discontinue features. Internet, hosting, database and third-party AI outages can affect availability. We will use reasonable care but do not promise uninterrupted or error-free operation.

10. Intellectual property

The application, branding, software and supplied assets remain owned by their respective rights holders. You retain rights in content you lawfully provide and give us a limited permission to process it only to operate, secure and improve the service.

11. Liability

To the extent permitted by applicable law, the service is provided on an “as available” basis. We are not responsible for indirect or consequential loss. Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

12. Governing law and changes

These Terms are governed by the laws of India, subject to mandatory consumer protections. Material changes will be shown in the app and may require renewed acceptance.
